General Terms and Conditions of Sale (GTCS) – Casa John

Company: MOON MAKERS AGENCY LDA, limited liability company, NIPC 517750929, registered office at Rua Manuel Mendes 36, Aroeira 2820-098 Charneca de Caparica, represented by HANNAH ISAURA GAUTHIER BOISFER or PATRICE SERGE BOISFER.

1. Acceptance of the Conditions

By using the Casa John website to make a booking, you automatically accept these terms and conditions. Confirmation of the booking is subject to acceptance of these terms and payment of the booking.

2. Booking Process

Availability consultation: Availability for the house can be consulted in real time on the dedicated page of our website. You can select your arrival and departure dates and the number of travellers.
Booking Confirmation: Booking is instantaneous and requires full payment.

3. Payment

Payment methods: Payment is made online by credit card. For other payment methods, please contact the owner through the form on the ‘Contact’ page or by email at contact.casajohn@gmail.com.
Security Deposit: A security deposit of €1,000 is required in the form of a bank imprint 24 hours prior to arrival and will be released within 7 days of departure, subject to the property’s cleanliness and integrity (damage to the property or furniture, dirt or other mess requiring special cleaning, any other costs incurred by the Owner as a result of the Tenant’s stay). If the property is dirty or damaged on arrival, the Tenant must inform the Owner immediately.

4. Cancellation

By the Client : Free cancellation up to 30 days before arrival. After this date, there will be no refund of the booking.
By the Owner: The owner reserves the right to cancel the booking in the event of non-compliance with the house rules, without refund. In the event of force majeure or any other circumstance beyond the owner’s control, the owner reserves the right to cancel the booking. In such a case, all sums paid by the tenant will be refunded. The tenant will not be entitled to any additional compensation.

5. Use of the Property

Location: The Local Accommodation property is a house with ground floor and first floor with courtyard and swimming pool, located at Rua Manuel Mendes, Nº 36, Aroeira, Charneca de Caparica. The property is rented with furniture and appliances.
Purpose: The owner rents and the tenant rents out the house identified above, which is intended for local accommodation, for which licence nº 155672/AL has been issued by Almada Town Council, for the period specified at the time of booking.
Capacity: The maximum occupancy of the accommodation is 8 people. Any additional persons may only be accommodated with the prior agreement of the owner. In the event of authorisation, an additional charge of 10% per night and per excess person will be applied.
Length of stay : The rental period begins at 3 p.m. on the day of arrival and ends at 10 a.m. on the day of departure. Failure to respect the check-out time may result in an additional late check-out charge of €100 per additional hour, unless a different time has been agreed prior to the stay and accepted by the Owner.

6. House Rules

Compliance with the house rules, available on our website, is compulsory. Failure to comply with these rules may result in additional charges or cancellation of the booking.

7. Access and inspections

The tenant must allow the Owner access to the property for repairs, inspections or in the event of an emergency. The Owner shall exercise this right of access in a reasonable manner, giving at least 24 hours notice. The Owner reserves the right to access the property without notice in the event of an emergency.

8. Protection of Personal Data

Personal information provided will be processed in accordance with data protection legislation. You have the right to request access, rectification and deletion of your personal data.

In accordance with article 9, no. 3 and article 10 of law no. 23/2007 of 4/07, it is compulsory for all foreign citizens to provide an identity document in order to comply with the legal requirements for entering and leaving Portuguese territory. This obligation applies to all persons staying at the property. These documents must be sent by e-mail to contact.casajohn@gmail.com, 7 days before the date of entry into the property.
In accordance with the provisions of the Personal Data Protection Act, in the context of the entry into force of the new data protection legislation, the Parties give their express consent for personal data to be entered and processed in the monitoring and transaction reporting databases, in the context of this contractual relationship.
The parties are guaranteed, in accordance with the exact terms of the legislation on the protection of personal data, the right to access, rectify, update or delete their personal data, as well as the right to object to their use for the purposes described in the previous number, having to indicate their disagreement in order to do so.


9. Legal Provisions

Applicable law: This contract is subject to Portuguese law.
Jurisdiction: For any dispute, the court of the Comarca where the property is located shall have jurisdiction, expressly waiving any other jurisdiction.
